'CHC advocacy: Last minute help'

Re. Advocacy in application for Continuing Health Care: My comments relate to what I understood to be the cheapest sort of legal support which was available. The next higher level seemed to offer the collection of evidence, an analysis, and the provision of a preliminary opinion. I thought I could do that myself so it would only have served to make things more expensive. However, because of my own preparation I felt that a more tailored fee would have been appropriate, but that was not on offer. At first there was the usual business of the contract and the forms to fill in, which probably could not be avoided, but Farleydwek handled most of that sort of thing over the arrangements for the CHC assessment itself, which was nice. We have not yet had a decision, ideally according to guidelines and the Law, with the distinct possibility of needing more help with the legalistic business of appealing in future. I have seen that decisions can often appear arbitrary, and that legal help would then become yet more expensive. In the end that seems just the way it is i.e. a lottery, but maybe I am being unfair. Anyway the advocacy turned out to be very expert and competent, exactly as claimed. I thought I knew it all but that was not the case, and advocacy did really help. The CHC assessor attended in person and the 'mutidisciplinary team meeting' was held with the help of a conferance program on her laptop, which clearly showed the image of the social security rep. and FD's advocate. Everyone was easy and quite sociable so the meeting was not at all unpleasant, only becoming formal when necessary. The sound was excellent and and I thought that the advocate helped things to go as well as possible. That might have happened anyway but she clearly grasped the whole situation and was extremely efficient, definitely steering things in a favourable direction upon several occasions. With so much money at stake I felt happy that the massive fee was worth it, regardless of the outcome....

Battling an unfair CHC system for several years whilst looking after a very ill husband on my own at home left me at the lowest ebb.
Finally I decided to pay for help and how I wish I had done this earlier .
The support and expertise from Andrew, Gill and Alex was excellent Things we just knew were wrong were proved to be so Four years after our first DST we were awarded CHC funding
The company respected our decision to appeal the previous year ourselves and we were awarded that .
Finally we asked them to look at tge earlier period They could have taken our money but instead guided us to see if it was a case worth fighting , which it was not .

Knowing from reports in the media that getting any reimbursement for Continuing Healthcare was a difficult process, and being told by the manager of Mum’s care home that she didn’t fit the criteria, we had no real hopes of a successful outcome. However, we decided that for the initial payment which equated a few more weeks of care home fees, we decided to get in touch with Farley Dwek, who we had heard specialised in these cases, we really had nothing to lose.
It isn’t an easy task for the family, as writing a report as well as reading what others had experienced over the last years of Mum’s life could be quite upsetting (she had dementia). It is also a very long process. A huge file of data was put together by Farley Dwek and submitted to the CHC panel. Eventually we were given recompense for the last ten weeks of Mum’s life. We were grateful and expected that to be final, but the team at Farley Dwek felt that was inadequate in light of Mum’s needs. We decided to appeal, and an independent panel very quickly awarded us recompense going back several years. We were absolutely delighted and felt that we had received justice for all the expense we had been put to during the nine long years Mum had been in care. It took five years from start to finish, but thanks to the hard work put in by the team at Farley Dwek, who kept us informed throughout, we had an amazing outcome, for which the family will always be very grateful.
