Enact Conveyancing failed to notice the boundary plan on my house purchase was incorrect. Despite the property information form clearly stating the purchase included a garage and further parking they somehow made a monumental mistake and proceeded to complete without noticing.
When I sold the property this issue came to light. They admitted their mistake and assured me I would be put back into the position I would have been had they not made this mistake. This transpired to not true, I am very much out of pocket.
They advised an indemnity policy which both my buyers and my solicitor objected to instantly. I would add that I had a qualified conveyancing solicitor as did my buyer, not just a conveyancer as Enact were. It was insinuated it was my solicitors fault which I vehemently objected to.
** A conveyancer is cheaper for a reason. They are not conveyancing solicitors and are not regulated by the Law Society. Please choose wisely as many people do not know the difference until negligence arises **
I asked Enact to cover the deduction. They refused. I pleaded for help but it fell on deaf ears. I wasn’t able to complete on my onward purchase due to the loss in value of my sale property - this loss the direct consequence of Enact Conveyancing.
In time I asked Enact for their insurance details so I could claim for just my losses and avoid legal costs. They wouldn’t provide them.
I had no choice but to proceed with the use of a solicitor. Again I slipped up with who I chose initially but when I came across Robert Johnson of Healys, London my situation changed instantly. He dealt with my claim and, in my opinion, Enact were floundering and no match for Robert. Both Robert Johnson and his firm Healys were nothing short of brilliant.
Whilst I won my claim I am most certainly not in the position I would have been had Enact not made this mistake. Far from it.
I have learned a lot during the whole process and will never be put in this position again.
Please learn from my experience and do not use Enact Conveyancing. If your lender insists then show them this review.
I am liaising with all lenders that partner with Enact and have just shared my correspondence with them. I hope they choose more wisely who they partner with once they read my paperwork.
It isn’t a matter of never making a mistake, no one is infallible. But it’s a case of how their mistake is handled. It is my opinion that Enact were unnecessarily callous and unco-operative towards me.
