Failed to recognise vulnerability, escalated enforcement prematurely
I was represented by Kingsley Napley in a high-profile matter. While the legal team was initially supportive, I was shocked by the inflexible and transactional approach I faced after the matter concluded. Despite having already paid over £250,000, my request to pay the remaining balance over time — due to financial and mental health concerns — was effectively dismissed.
Kingsley Napley proceeded to secure a default judgment, despite receiving post-claim payments. They have since admitted the judgment sum included a miscalculation, yet refused to withdraw the CCJ. No effort was made to assess vulnerability or consider the emotional harm caused by their conduct.
The approach lacked both empathy and proportionality. A firm of this stature should hold itself to a higher standard when dealing with a longstanding client under genuine distress. I have submitted complaints to both the SRA and Legal Ombudsman.
