Access to neighbouring land for the purpose of maintenance of property
Mr Rajendra has been very thorough in his work whilst dealing with the lengthy case which lasted for more than 3 years and 6 months. He has been extremely professional along with great communication skill all throughout the time the case lasted. The property in question is in Totteridge and was built in 1984 with planning permission which after settlement had 3 superficial cracks on the wall . The neighbour contested the wall was unsafe and had health and safety issues. They also purported that the foundation of the wall was shallow. Mr Rajendrakumar ordered professional surveyors in 2021 to do a full survey of the property especially the boundary wall in question. A pit was dug to determine the foundation of the wall . It came out that the foundation was well over 1200 mm as opposed to their assertion that it was 400 mm only. The second issue they objected was that the eaves of the property was overhanging on their land. But this was done with planning permission and it is now over 40 years since when it was built. They became owners of the next door property after the property in question was built. However they did not allow the previous owners of this property to repair the wall. When I came I stayed in the best terms for 18 years in the hope that they would allow me to repair the wall. But that did not happen . It was then that Mr Rajendrakumar MEGHA intervened . It was a lengthy battle and had many hurdles on his way. But he responded to all with great skill and knowledge that it was a pleasure to be with him whilst dealing with the case. I was made aware the correspondences from the other side of the solicitors at all time and his response to their mails with great analysis. During the lengthy period I had direct face to face contact with my solicitor. I was not worried about the cost ; I wanted the outcome and repair my property. During the period the case was active we had been to court on numerous occasions . Although the neighbours lost their case each time they would frustrate the outcome by defaulting the Court Order. The Court Order had a Consent Order all signed and agreed by the parties and the judge also ordered the cost to be paid by the neighbour. Although Access order was pronounced by the judge, the neighbours defaulted the order by resisting the order on the agreed date thus causing further expense due to the team of workmen attending with their Scalfolding. My solicitor had to make new applications to the court as they had neither paid the costs nor they had allowed access. The neighbours had to pay £31000 cost with daily interest which they kept avoiding and Mr Rajendrakumar finally applied an interim charge followed by a final charge on their property. They have also been very secretive by trying to change name of ownership their property thus frustrating the charge. But Mr Rajendrakumar was way ahead of them to frustrate their secret plans.
On a final note because of their attitude, arrogance and behaviour towards the judges order ; Mr Rajendrakumar made application to court for committal to prison for contempt of court which is now due to have a hearing in September 2024. It was then that the neighbours allowed access and have made payments to my solicitor . Payments are still due for the rest of the works done post Final Charging Order.
It has been a real battle during the past years and it was a pleasure to note how Mr Rajendrakumar conducted the whole case all together.
I would highly recommend Mr Rajendrakumar MEGHA to any one in difficulty. I am sure he will take you through tryout difficulties.
The best part of it is that Mr Rajendrakumar recovered all the costs from the other side and i did not have to pay any fees from my side.

Very professional
