As an accredited member of the Law Society Mental Health Tribunal Panel, Adam accepts instruction in relation to civil and forensic mental health law matters including Tribunal Hearings, Hospital Managers’ Hearings and CPA/s117 meetings. I would like to provide my feedback for GT Stewart solicitors, the service that I received was very professional, I felt supported enormously. I phoned GT Stewart solicitors to dispute my discharge of my section 2 admission of the Mental Health Act. Both Mr Adam Marley and his trainee solicitor Raj came to visit me at the Priory Hospital, my case was dealt with very quickly both and in person. I was supported greatly by the team to better understand my rights and the other alternative steps to take to help facilitate the process of my discharge. My situation was very challenging and difficult for the solicitors as there was a breakdown in the relationship of my immediate siblings and nearest relative at the time, despite this our relationship has gradually improved after my discharge. The tribunal greatly assisted me as it helped the medical team and the doctors to gain a clearer understanding of my exact issues and as a result, I was able to have the correct medical steps taken that were appropriate for my medical needs, I was also assisted with appropriate housing by the council. One of the strengths of Mr Adam Marley’s services, is that he is able to treat every client with the right dignity and respect needed in the most challenging and most unpleasant situations. Mr Adam Marley was able to communicate effectively and provide fair legal representation aiming to improve and facilitate the doctor and patient relationship. I would like to thank his team for their generosity and their work ethic by aiming to not only provide justice but to improve the proper practice and duty of care required by the medical team.

DD v Sussex Partnership NHS Foundation Trust [2022] UKUT 166 (AAC)

Change of status - s37/41 to conditional discharge DD applied to the MHT while subject to a s37/41 restricted hospital order but, before the hearing, was conditionally discharged: the MHT decided that it ceased to have jurisdiction. He appealed to the UT but, before that hearing, was absolutely discharged: the UT decided that it retained jurisdiction and should decide the case despite it being academic. The UT concluded that the MHT retain jurisdiction when a s37/41 patient is conditionally discharged.
